As a consumer, you benefit from the following legal guarantees:
You are entitled to a 2-year conformity guarantee starting from the delivery of your product. This guarantee allows you to request an exchange or repair if the product has a conformity defect (e.g., not as described, malfunctioning, etc.).
In case of a hidden defect affecting your product, you can exercise the hidden defects guarantee. This guarantee allows you to request a refund or exchange if the product has a defect that was not apparent at the time of purchase.
Exclusions from the Guarantee
The following damages are excluded from this guarantee:
– Visible defects at the time of purchase: If the customer accepted the product despite visible defects (such as a stain on the fabric or uneven stitching).
– Normal wear and tear: Wear due to normal use of the product over time (e.g., color fading, loss of elasticity over time).
– Misuse or improper care: A product damaged due to improper use (e.g., incorrect washing, improper storage, or use that does not follow the instructions).
– Fabric pilling: Unless it occurs excessively or prematurely, fabric pilling is generally considered normal wear.
– Color bleeding: If this occurs due to improper care (e.g., washing bright-colored clothes with white garments), it will not be covered.

Return shipping costs are your responsibility unless the product is defective or non-compliant. Article 1 – Purpose
The present contract determines the rights and obligations of SPL EVA and the consumer in the context of the sale of products offered by SPL EVA on its merchant website (www.sainte-marie-mineral.com). The general terms and conditions of sale constitute the entirety of the rights and obligations of the parties, and no other condition may be incorporated into them.
Article 2 – Contractual documents
This contract is formed by these general sales conditions and, in decreasing order of legal value, the order form.
Article 3 – Applicable law and jurisdiction
The present conditions are subject to French law. The competent court in the event of a dispute shall be that of the defendant’s place of domicile or, at the plaintiff’s option, the place of actual delivery of the product.
Article 4 – Characteristics of goods and services offered
The products available for sale are those shown on the www.sainte-marie-mineral.com website. Each product is accompanied by a description of its essential characteristics. SPL EVA makes every effort to ensure that the visual representation of the products is as faithful as possible to the products themselves. However, given the digital presentation of products on the Internet, it is possible that the customer’s perception of the photographic representation of the products does not correspond exactly to the product itself.
Article 5 – Commitment
When the customer confirms their order, they are irrevocably bound, and their acceptance cannot be called into question except in the cases exhaustively provided for in these GCS (see right of withdrawal).
Article 6 – Prices
Prices are indicated in euros, all taxes included. These prices exclude shipping costs, which are added to the final total of the order according to the weight of the parcel and its destination. Prices include VAT applicable on the date of the order. Any change in the applicable rate of VAT may be reflected in the prices of the products.
Article 7 – Order confirmation
SPL EVA confirms acceptance of the order to the customer by the means of his choice: email or publication on the customer’s account before delivery of the order. This confirmation will summarize all elements relating to the order.
Article 8 – Proof of transaction
Computerized registers, kept in SPL EVA’s computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
Article 9 – Withdrawal period / Refund and exchange
The consumer has a period of 14 days to exercise his right of withdrawal without having to justify his reasons or pay any penalty. Return shipping costs are at the consumer’s expense. The refund or exchange (subject to stock availability) will be made within 30 days of receipt by SPL EVA of the products returned by the consumer in their original condition.
Article 10 – Delivery
SPL EVA undertakes to deliver products within a maximum of 30 days from the date of order. Products are delivered to the address indicated by the customer on the order form. In the event of delay, the customer will be informed as soon as possible and may cancel the order. The customer will then have the choice of requesting either a refund of the sums paid within 14 days of payment, or an exchange of the product.
Article 11 – Payment
Payment is due with the order. Payments will be made by credit card; they will be made via a secure system using SSL (Secure Socket Layer) protocol, so that information transmitted is encrypted by software and cannot be read by any third party during transport on the network.
Article 12 – Personal information
SPL EVA is committed to protecting its customers’ personal data. The data collected by SPL EVA at the time of any customer order is necessary for the management of the transaction and for this reason, can be communicated in whole or in part to the service providers of SPL EVA intervening within the framework of the execution of the order. Consumers have the right to access, modify, rectify and delete data concerning them.
Article 13 – Security
Transactions carried out on the www.sainte-marie-mineral.com website are secured by an online payment system which incorporates data protection and encryption measures to protect all data linked to payment methods.
Article 14 – Settlement of disputes
In the event of a dispute, an amicable solution will be sought before any legal action is taken. In the absence of an amicable solution, any dispute arising from the present contract will be submitted to the competent courts in accordance with the jurisdictional rules of French legislation.
Modification of GTC: SPL EVA reserves the right to adapt or modify these GTC at any time. The new terms and conditions will only apply to sales made after the modification.
